Frequently Asked Questions
What penalties apply if I lodge my SMSF return late?
The ATO applies failure-to-lodge (FTL) penalties for late SMSF returns. From 7 November 2024, the penalty is $330 per 28-day period your return is overdue, up to a maximum of $1,650 per return. Beyond financial penalties, your fund’s status on the Super Fund Lookup may change to “regulation details removed,” which can prevent you from accepting rollovers or contributions. In serious cases of continued non-compliance, your fund may lose its complying status and be taxed at the highest marginal rate instead of the concessional 15% rate.
Is the ATO focusing more on SMSF compliance this year?
Yes. The ATO’s 2025-26 Corporate Plan lists outstanding SMSF annual returns as a key compliance priority. This means the ATO is taking a tougher approach to late lodgements and will escalate compliance action faster than in previous years. If your return is overdue, we recommend acting immediately to avoid penalties and potential enforcement action.
Does my SMSF need to lodge a return if it had no income or activity?
Yes, in most cases. Your SMSF must lodge an annual return even if it had no income, made no transactions, or held no assets during the year. The only exception is if the ATO has granted your fund “Return Not Necessary” (RNN) status, which requires a formal application. If your fund is being wound up, you may be able to lodge a nil return. We can help you determine your fund’s lodgement obligations and apply for RNN status if appropriate.
What SMSF issues is the ATO paying special attention to in 2025-26?
The ATO has identified several compliance focus areas for 2025-26, including:
Outstanding SMSF annual returns
Market valuations of assets
Non-arm’s length income (NALI) arrangements
In-house asset breaches
Disqualified trustees
Release and commutation authority compliance
We stay up to date with ATO compliance priorities and can help you address any issues before they attract ATO attention.
Do I need to lodge an SMSF tax return every year?
Yes, most SMSFs are required to lodge an annual return with the ATO each financial year, even if the fund didn’t earn income or is in the pension phase. Lodging is a legal requirement to stay compliant and pay any applicable supervisory levy.
What happens if I don't lodge my SMSF annual return on time?
Failing to lodge your SMSF tax return on time can result in administrative penalties, fines on each trustee, and potential loss of concessional tax status. The ATO takes non-lodgement seriously and may take enforcement action against trustees who don’t meet their obligations.
Can I complete my SMSF tax return online?
Yes, the ATO offers online lodgement through its online services page. We can help you prepare the information needed for online lodgement or submit it on your behalf to ensure accuracy and compliance.
Can you help with more than just lodging my SMSF return?
Yes. As registered tax agents, we can prepare and lodge your SMSF annual return, provide tax advice related to your fund, help you with record-keeping and documentation, and represent you in dealings with the ATO on tax matters. However, we are not licensed to provide financial product advice, such as recommending specific investments or whether you should set up or wind up your SMSF. For those decisions, you should consult a licensed financial adviser.
